Kennedy v. Louisiana - Alito's Dissent

Alito drafted the dissent and was joined by Thomas, Scalia, and Roberts. The dissent is notable because this is the first time four Justices have seemingly eschewed modern 8th Amendment methodology in favor of an originalist analysis. As Alito makes clear at the outset: The Eighth Amendment’s requirements, the Court writes, are “determined not by the standards that prevailed” when the Amendment was adopted but “by the norms that ‘currently prevail.’ ” Alito then launched into a scathing attack
